{"id":30251,"date":"2013-01-19T00:47:41","date_gmt":"2013-01-19T00:47:41","guid":{"rendered":"https:\/\/wagners1.wpenginepowered.com\/blog\/canadian-armed-forces-class-action-class-action-overview\/"},"modified":"2013-01-19T00:47:41","modified_gmt":"2013-01-19T00:47:41","slug":"canadian-armed-forces-class-action-class-action-overview","status":"publish","type":"post","link":"https:\/\/wagners.co\/fr\/blog\/canadian-armed-forces-class-action-class-action-overview\/","title":{"rendered":"Canadian Armed Forces Class Action - Class Action Overview"},"content":{"rendered":"\n<div class=\"page-header\"><\/div>\nOn November 21, 2016, <a href=\"https:\/\/wagners.co\/news-insights\/canadian-armed-forces-class-action-class-action-overview\/\">Wagners<\/a> commenced a proposed class action on behalf of all persons in Canada <u>who are currently or were formerly <\/u>Members of the Canadian Armed Forces and who identify as female.\n\nThe action alleges that the Government of Canada is responsible for the systemic gender- and sexual-orientation-based discrimination, bullying, harassment and sexual assault of female members within the Canadian Armed Forces.\n\nThe action also claims that female members\u2019 rights to be free from discrimination on the basis of sex, which is protected by the <em>Canadian Charter of Rights and Freedoms<\/em>, has been violated.\n\nThe suit does <u>not name or sue individual people<\/u> for their discriminatory or abusive actions towards female members of the Canadian Armed Forces.\n\nRather, this is a civil lawsuit claiming that the <u>Government of Canada<\/u> is vicariously liable for the sexual misconduct of the male members of the CAF. <u>Vicarious liability<\/u> assigns legal responsibility for the harm and injury suffered by female members at the hands of male members of the CAF to the <u>Canadian Government<\/u>.\n\nAs well, this action is focused on <u>systemic<\/u>\u00a0discrimination, bullying, harassment and sexual assault of female members.
