Yarmouth Airport PFAS Contamination

A proposed class proceeding has been filed on behalf of property owners in an area next to the Yarmouth Airport who have learned their properties are contaminated by PFAS. Transport Canada, the former owner of the Airport, used PFAS-containing fire fighting foam at the fire-fighting training area at the Airport before it was sold in 1997. In 2024, property owners began to be notified about the PFAS contamination. It is alleged that there has been a loss of value of the properties as a result of the contamination.

juillet 8, 2025

On July 8, 2025, a Notice of Action and Statement of Claim was filed in the Supreme Court of Nova Scotia against the Attorney General of Canada for loss of value of properties in an area next to the Yarmouth Airport as a result of PFAS contamination.

mai 29, 2026

Wagners has filed an Amended Notice of Action and Amended Statement of Claim severing liability from the companies and corporations involved with the design, manufacture, importation, marketing, or sale of PFAS-containing AFFF (Aqueous Film Forming Foam).

The defendant has advised that it plans to bring a motion to strike the claim and, if unsuccessful in their motion, seek to add the current Yarmouth Airport owners as a third party to the claim. The motion to strike is scheduled for June 24, 2026. The certification motion has not yet been scheduled.

We will provide a further update once we receive the motion materials and the Court has addressed the next steps.

juin 22, 2026

The Defendant’s motion to strike the claim, previously scheduled to be heard on June 24, 2026, has been rescheduled.

The motion is now scheduled to be heard on September 14, 2026, with September 15, 2026 reserved as a carry-over date if additional time is required.

The rescheduling was required due to the scope of the materials filed and the Court’s availability.
