Chipman v. Biomet, Inc. et al

Wagners filed a proposed class action on behalf of Canadians implanted with a Biomet Metal on Metal Hip Implant System between 1998 to the date of certification. The action was filed on May 1, 2014 in the Supreme Court of Nova Scotia in Halifax. It is alleged that Biomet’s metal-on-metal hip implant system fails prematurely, thereby causing bone dislocation, metallosis and the need for further surgery. The class action has been filed against five different entities of the Biomet group. The proposed class action seeks damages for individuals who required surgery to correct the defective hip implant. September 3, 2024

On December 20, 2021, we advised that our firm is no longer actively advancing this class action, and that persons interested in the case should contact Stevenson Whelton LLP concerning the national Biomet class action advanced by that firm and others.

There is now a proposed settlement agreement in that national class action. The Ontario Superior Court of Justice will be hearing a motion for approval of the proposed settlement on October 25, 2024.
