Boating Accident Claims

Boating continues to be a popular recreational activity, as people enjoy the outdoors in the warmer months. Unfortunately, accidents, injuries and fatalities have increased as boaters who have little experience take to the water. Just as you would take proper care and safety precautions while driving a vehicle on the road, the same considerations should be made for motorized water vehicles.

Some common causes of boating accidents include:

  • Operator inexperience
  • Operator negligence
  • Passenger and/or water skier actions
  • Poor weather conditions
  • Equipment failure
  • Reckless operation

Operation under the influence of alcohol or drugs

If you operate any motorized vessel you must carry proof of competency such as a boating safety course taken in Canada before April 1, 1999 or a Pleasure Craft Operator Card (PCOC). The Pleasure Craft Operator Card is good for life, and is recognized across Canada. All boats are required to carry safety equipment. All equipment should be checked regularly, be well maintained, and replaced if necessary. There must be a Canadian approved life jacket or personal floating device (PFD) of the appropriate size for everyone on board.

If you are injured in a boating accident, you may be entitled to compensation. Liability for your injuries can get very complicated, and a lawyer can help you navigate the seas of pursuing a claim. If you or a loved one have been seriously injured, and you are unsure what you can claim for, the legal team at Wagners can help you.

Just as drivers must obey the rules of the road, boaters must operate their vessels responsibly, lawfully and with a proper level of care for other boaters, passengers and those in the immediate area. Snowmobilers and those driving ATVs must operate their vehicles with a lawful standard care for their passengers and those around them.

Negligent operation of boats, ATVs or snowmobiles can result in serious injury to those participating or those in the area where the activities are taking place. Accidents and injuries can arise from:

  • failure to travel at safe speed limits;
  • failure to have proper safety equipment or failure to maintain safety equipment in good repair;
  • failure to use rules of right-of-way;
  • failure to maintain a proper look out;
  • failure to warn of approaching dangers; and operation of a vehicle or vessel under the influence of alcohol or drugs.
