Wagners has filed a proposed class proceeding arising from a mass privacy breach of health information at St. Martha’s Regional Hospital in Antigonish, NS.

2,690 patients have been notified of the breach by Nova Scotia Health.

A clerical employee inappropriately accessed, without a valid purpose, the medical records of these patients between May and September 2023.

An action has been filed in the Nova Scotia Supreme Court seeking a remedy for the affected individuals.

Updates & Latest Developments

A hearing of the Plaintiff’s certification motion has been scheduled in the Supreme Court of Nova Scotia. It will take place on November 12 and 13, 2025 commencing at 9:30 a.m. each day at the Law Courts Building, located at 1815 Upper Water Street in Halifax.

If the Plaintiff’s proposed class proceeding is certified, that means it can proceed to a trial. It is at the trial where the merits of the allegations will be decided by a judge. The certification motion is a procedural step, not the trial.
